To renew your work permit (EAD), you file Form I-765, Application for Employment Authorization, with USCIS before your current card expires. If this is your first work permit, start with our guide on the USCIS work permit process and processing time.

Timing matters more than ever. For most EAD renewals filed on or after October 30, 2025, there is no automatic extension anymore. If you file late, you could be left without permission to work while you wait. An immigration attorney can help you plan your renewal from the start.

When should you renew your work permit?

For most categories, USCIS lets you file your renewal up to 180 days before your current EAD expires. The best strategy is to file as soon as that 180-day window opens.

Since October 30, 2025, most renewals no longer get an automatic extension. That means if your card expires before USCIS approves the new one, you cannot keep working legally until the new card arrives.

Planning early protects your job, your income, and your immigration record. Before you count your days, check the current processing time for your category on the USCIS website or in our post on how long a work permit takes.

StepWhat to do
1Find the exact expiration date on your current EAD.
2File Form I-765 as soon as you are within 180 days of that date.
3After you get your receipt notice (Form I-797C), check your case status online regularly.

What changed with the automatic EAD extension?

Until October 29, 2025, people in certain categories who filed their renewal on time could get an automatic extension of up to 540 days. That extension let them keep working while USCIS processed the renewal.

On October 30, 2025, the Department of Homeland Security (DHS) ended this benefit through an interim final rule published in the Federal Register. For most EAD renewals filed on or after October 30, 2025, there is no automatic extension.

If you filed your renewal before October 30, 2025, in an eligible category, your automatic extension of up to 540 days still applies. Your Form I-797C receipt notice, together with your expired EAD, is the proof your employer needs.

The only exceptions for new filings are extensions provided by law or by a Federal Register notice, such as those for Temporary Protected Status (TPS). Check your situation on uscis.gov or talk to an attorney.

Categories that qualified for the automatic extension

These categories, among others, qualified for the 540-day extension only if the renewal was filed before October 30, 2025. Renewals filed after that date do not get it (except TPS cases covered by a Federal Register notice):

  • A03 and A05: refugees and people granted asylum.
  • A07: N-8 or N-9 nonimmigrants (certain parents and children of special immigrants).
  • A10: people granted withholding of deportation or removal.
  • A12 and C19: TPS beneficiaries and TPS applicants.
  • C08: people with a pending asylum application.
  • C09: people with a pending adjustment of status (Form I-485). Learn more about the C09 work permit.
  • C24: LIFE Act legalization applicants.
  • C31: VAWA self-petitioners with an approved I-360.

Always confirm the current categories and rules on the official USCIS website, because they can change.

What documents do you need to renew your work permit?

A complete, well-organized package helps you avoid delays. Send clear, readable copies. Send originals only if USCIS asks for them.

Form I-765 is the main document, but you also need supporting evidence. Missing or wrong documents can lead to a rejection or a Request for Evidence (RFE), which adds more waiting time.

  • A copy of your current EAD (front and back).
  • A copy of your Form I-94 (Arrival/Departure Record), if you have one.
  • A copy of your visa, if you have one.
  • A copy of your passport (biographic page and entry stamps).
  • Two identical passport-style photos taken within the last 30 days.
  • A copy of your I-485 receipt notice, if your work permit is based on a pending adjustment of status.

If your work permit is tied to a pending I-485, DACA or deferred action, or another immigration category, legal advice can help you put the right package together.

How much does it cost to renew your work permit, and how do you pay?

Check the current USCIS fee before you file, because fees change. If you pay the wrong amount, USCIS can reject your application and you lose time.

Under the USCIS fee rule that took effect on April 1, 2024, the standard I-765 fee for most categories depends on how you file:

How you fileStandard fee
Online (myUSCIS account)Lower fee (check Form G-1055)
Paper (by mail)Higher fee (check Form G-1055)

Some categories pay a different amount. For example, an I-765 filed together with or based on a pending I-485 filed after April 1, 2024, has its own fee, and some categories, such as asylum-related ones, have had extra fees added by law since 2025. In most cases there is no separate biometrics fee. Fee waivers exist, but only for specific categories with strict requirements. To find your exact fee, check the USCIS fee schedule (Form G-1055) and our guide on the work permit renewal fee.

How to pay: USCIS has moved to electronic payments. For most paper filings, you pay by credit or debit card with Form G-1450 (Authorization for Credit Card Transactions) or by bank account withdrawal (ACH) with Form G-1650. If you file online, you pay in your myUSCIS account. Check the form instructions before you send a check or money order.

What happens if your work permit expires before USCIS approves the renewal?

Even if you file on time, USCIS delays can make your EAD expire before the new card arrives. Working without authorization can seriously hurt your immigration case.

  • Check your filing date. If you filed before October 30, 2025, in an eligible category, you may still have an automatic extension. If you filed on or after that date, you have no automatic extension (except TPS cases), and you must stop working when your card expires. Your Form I-797C is the proof your employer needs if you do have an extension.
  • Talk to your employer. Explain where your renewal stands and make sure they know how to verify any extension.
  • Track your case. Use the USCIS Case Status Online tool. Here is how to check your USCIS case status.
  • Look at other options with an attorney. Some people may qualify for another path to lawful status or work authorization, such as adjustment of status.

Never work without authorization, even if you think your approval is just days away. Having a work permit also does not fully protect you from removal; learn more in our post on whether you can be deported with a work permit.

Frequently asked questions about renewing your work permit

What if my EAD category does not qualify for an automatic extension?

If your category did not qualify, or you filed on or after October 30, 2025, your permission to work ends on the expiration date printed on your card, and you must stop working. File your I-765 as soon as you are within 180 days of that date, and ask an attorney whether you have other options.

How long does USCIS take to approve a work permit renewal?

It depends on your category and the office handling your case, and it can take several months. Check the current USCIS processing times for your category and track your case online.

How do I check my work permit renewal status online?

Use the USCIS Case Status Online tool with the 13-character receipt number on your Form I-797C (three letters followed by ten numbers). Check regularly for updates and for any Request for Evidence.

Can I travel outside the U.S. while my work permit renewal is pending?

A pending I-765 alone does not let you travel. If you also have a pending I-485, leaving without Advance Parole can cause USCIS to treat your green card application as abandoned. In addition, under a Board of Immigration Appeals decision issued on August 13, 2026 (Matter of Delcarmen-Lara), leaving the U.S. on Advance Parole now counts as a departure for the 3- and 10-year unlawful presence bars. If you have more than 180 days of unlawful presence, you could be barred from returning. Talk to an immigration attorney before any trip.

What happens if I wait too long to file my renewal?

Your card may expire before the new one is approved, and you would have to stop working until it arrives. Because most renewals filed on or after October 30, 2025, no longer get an automatic extension, filing as soon as the 180-day window opens is more important than ever.

Do I need to renew my work permit if my green card is pending?

If your I-485 is still pending and your EAD will expire before USCIS decides your green card case, you should generally renew. A C09 renewal filed before October 30, 2025, may still have its automatic extension, but renewals filed on or after that date do not. Talk to an attorney about current processing times to decide when to file.
