C09 Work Permit: Who Qualifies, Documents and Processing Time

8 min read

What is the C09 work permit category and who does it apply to?

The C09 work permit category, written (c)(9) on the application, lets you work legally in the United States while your adjustment of status application (Form I-485) is pending with USCIS. Not everyone who files qualifies automatically; specific requirements decide who is eligible.

Knowing these requirements early can help you avoid delays. If you want your application reviewed before you file, our work permit attorneys are ready to help.

What is a C09 work permit used for?

This employment authorization document (EAD) lets you work legally while you wait for a decision on Form I-485, your application to become a permanent resident. It’s a bridge that gives you financial stability during a process that can take months or even years.

With a C09 EAD, you can look for a job, support your family, and build your life in the U.S. without worrying about working without authorization while your green card case is decided.

Who can apply for a C09 EAD while waiting for a green card?

You can apply if you have a properly filed Form I-485 that is pending with U.S. Citizenship and Immigration Services (USCIS). That’s the core eligibility requirement.

“Properly filed” means more than just mailing the form. Your I-485 must be complete, signed, filed with the right fee, and based on a category you’re actually eligible for. A case missing essential evidence or with a basic eligibility problem can be rejected or denied.

RequirementWhat it means
Pending Form I-485You must have an Application to Register Permanent Residence or Adjust Status (I-485) that was filed with USCIS and hasn’t been denied or withdrawn.
A valid basis to adjustYour I-485 must be based on a valid category, such as a family petition (I-130) or an employment petition (I-140). If you’re the immediate relative of a U.S. citizen, you can file the I-130 and I-485 together; you don’t have to wait for the I-130 to be approved.
Lawful entryIn general, you must have been inspected and admitted or paroled into the U.S. Immediate relatives of U.S. citizens can usually adjust even if they overstayed their visa, and other exceptions exist (such as INA 245(i) or VAWA). These cases need advice from an adjustment of status attorney.
No bars to adjustmentYou must not have serious criminal history or immigration fraud that makes you ineligible to adjust status.

If your I-485 has basic problems, such as no qualifying petition or an entry without inspection with no exception that applies, your work permit application will likely be denied too. That’s why it’s so important for your adjustment case to be solid from the start.

What documents do you need to apply for a C09 EAD?

Once you’ve confirmed you’re eligible, the next step is preparing Form I-765, Application for Employment Authorization. The key is accuracy and completeness.

An incomplete package or one with errors can lead to delays or a denial. Check everything carefully before you file.

Essential documents include:

  • A completed Form I-765: make sure you enter the correct category, (c)(9).
  • Proof your I-485 is pending: a copy of your Form I-797C receipt notice for the I-485 (or file the I-765 together with your I-485).
  • Two passport-style photos: recent and in the format USCIS requires.
  • A copy of your ID: a passport, birth certificate with photo ID, or other government-issued ID.
  • A copy of your Form I-94: your arrival/departure record, if you have one.
  • Copies of any travel documents: such as your visa, I-20, or DS-2019, if they apply to your case.
  • The filing fee, if one applies: check the current USCIS fee schedule (Form G-1055). Since April 1, 2024, most people filing the I-765 with their I-485 pay a separate fee.

Keep all the evidence supporting your I-485 (marriage certificate, children’s birth certificates, proof of your relationship, and so on) ready in case USCIS asks for it. A well-documented case from the start helps prevent Requests for Evidence that slow things down.

How long does USCIS take to process a C09 work permit?

Processing times vary a lot depending on USCIS workload, the office handling your case, and how complex your application is.

Times can range from a few months to more than a year. You can check current estimates on the official USCIS processing times page, which is updated regularly by form and office. You can also read our guide on USCIS work permit processing times.

Checking these times helps you set realistic expectations. Keep in mind they’re estimates, and your case may take more or less time.

What to do if your C09 EAD is delayed or denied

A long delay creates uncertainty, and a denial can affect your ability to work. That’s why it helps to know how to react.

  1. Check your status online: use your I-765 receipt number in the USCIS case status tool. You can also learn how to check your USCIS case status in detail to understand what stage it’s in.
  2. Contact USCIS: if your case is outside normal processing times, open a case inquiry in your online account or call the USCIS Contact Center with your receipt number handy.
  3. Read the denial notice: if your work permit is denied, USCIS will send a letter explaining why. Understanding the reason is key to deciding what to do next. Denials are often caused by errors in the application or missing evidence.
  4. Talk to an attorney: if the delay is significant or your application was denied, get professional guidance. An attorney can help you understand your situation, see whether you can file a motion or reapply, and protect your underlying green card case.

Don’t assume a delay means a denial; sometimes the review just takes longer. Staying on top of your case is the best way to keep it moving.

How long is a C09 work permit valid?

Once approved, a C09 EAD is generally valid for up to two years, though USCIS can give a shorter period depending on your case. Keep careful track of the expiration date, because it drives your next step.

If your card is about to expire and your I-485 is still pending, you can renew it by filing a new Form I-765 up to 180 days before the expiration date. Important: for most renewals filed on or after October 30, 2025, the automatic extension of work permits no longer applies to the C09 category. If your EAD expires while your renewal is pending, there may be a gap when you can’t work legally. Filing your renewal early is the best way to avoid it.

If you have questions about your timeline, our green card attorneys can help you plan.

Understanding this work permit category helps you keep your stability and your immigration case on track while you wait for a decision on your permanent residence.

Frequently asked questions about the C09 work permit

What kind of work can I do with a C09 work permit?

With a C09 work permit, you can take almost any lawful job in the United States: full-time or part-time, in any industry, as long as you meet each employer’s requirements. Unlike specialized work visas, the C09 category doesn’t limit you to one employer or occupation. It lets you earn income while USCIS processes your green card application.

What happens to my C09 work permit if my I-485 is approved or denied?

If your I-485 is approved, you get your green card and no longer need the C09 work permit, because permanent residents are authorized to work. If your I-485 is denied, your C09 work permit generally ends as well, since it depends on a pending adjustment application. If your I-485 is denied, talk to an attorney right away to review your options, such as a motion to reopen or reconsider or, in some cases, filing again.

Do I need a job offer to apply for a C09 work permit?

No. You don’t need a specific job offer to apply for a C09 EAD. Eligibility is based on having a properly filed, pending Form I-485. Once your EAD is approved, you can look for work in any field you want, which gives you more flexibility than many work visas.

Can I travel outside the U.S. with only a C09 work permit while my I-485 is pending?

A work permit alone doesn’t let you return to the U.S. after leaving. If you leave without Advance Parole (Form I-131), USCIS will generally consider your I-485 abandoned. And even with Advance Parole, under a Board of Immigration Appeals decision issued on August 13, 2026 (Matter of Delcarmen-Lara), leaving the U.S. on Advance Parole now counts as a departure for the 3- and 10-year unlawful presence bars. If you have more than 180 days of unlawful presence, you could be barred from returning. Talk to an attorney before you travel.

If my I-485 has minor errors, can I still qualify for a C09 work permit?

If your I-485 has minor or easily fixed errors, USCIS may send a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID), giving you a chance to correct them. As long as your I-485 isn’t rejected or denied for a serious defect, your C09 work permit can still be approved. However, major errors or the lack of a valid basis to adjust usually lead to the denial of both applications.
